Abstract

The priority of human rights and freedoms – the guiding principle of relations of the individual and the state. The state should be linked with human rights. In accordance with the Constitution of the Republic of Kazakhstan state is obliged to protect the dignity of the individual in all areas than affirms the priority of the individual, his rights and freedoms. It follows that a person in her relations with the state does not act as an object of government activity, and as an equal entity that has the right to defend their rights and freedoms by all means not contradicting the law, and argue with the state on behalf of any of its organs. We believe that the need to achieve a balance in the relations between the individual and the state, by determining the proportionality of the interference in privacy.
