The concept of pre-trial proceedings in criminal procedural legislation of the Russian Federation and Kazakhstan

Abstract

The article is devoted to comparative legal study of the basic concepts that characterize the pre-trial proceedings in criminal cases under the laws of the Russian Federation and the Republic of Kazakhstan. Considerable attention is paid to the terms and categories that characterize the pre-trial proceedings as a special kind of social activities.Kazakhstan and Russiacriminal procedure legislation contain definitions comparable within the meaning and in content which however have a number of differences caused not only by terminological variety but they have an essential deep meaning. The research of these differences has not only theoretical value, it also allows to better discover advantages and disadvantages of various wordings and to use them during the improvement of the current legislation.
