The environmental dimension in the era of Big Data and the digitalization of justice

Abstract

The article is devoted to the analysis of the digital judicial system as a legal category and an object of legal regulation, in the context of discussing the directions of introducing artificial intelligence into legal processes, as well as into the activities of judicial and law enforcement agencies in environmental protection. Improving the digital processes of accessibility of justice to the population of the Republic of Kazakhstan is a reality of today, however, one of the factors hindering these trends is the lack of legal support for the integration of artificial intelligence into digital processes. The introduction of artificial intelligence into the digital platform of critically important natural objects requires legal regulation at both the national and international levels, since the environmental impact is of a transboundary nature. The methodological basis of the work includes an analysis of the digital judicial system as the main element of ensuring environmental safety, focusing on environmental obligations not only in accordance with individual environmental treaties, but also in accordance with general international law and at the theoretical level by combining traditional methods of induction and deduction, axiomatic method, analysis and synthesis of doctrinal provisions, legal norms (domestic and foreign in the comparative aspect), as well as law enforcement practice. It forms the theoretical and legal foundations for understanding the role of digitalization in ensuring environmental justice.
