The regulatory and legal system of Kazakhstan for the provision of social assistance to the elderly
Abstract
The article examines the types and forms of social services to protect the rights of older citizens. The protection of the elderly is, as we have already mentioned, one of the fundamental principles of social policy and is expressed in the regulation of the human right to protect their rights and freedoms. The legal system of the Republic of Kazakhstan consists of legislative, regulatory and other acts that protect the
rights and interests of citizens of the country, including older citizens. In general, the legislation on social
security of older people in Kazakhstan is presented at the proper level. Kazakhstan ratified a number of
international treaties, which were reflected and developed in national legislation. The main law of the
country is the Constitution of the Republic of Kazakhstan. It contains norms that enforce the rights of all
citizens, regardless of age, as well as norms specifically relating to the elderly. In accordance with Art. 28
of the Constitution of the Republic of Kazakhstan, a citizen of the Republic of Kazakhstan is guaranteed
a minimum wage and pensions, social security by age, in case of illness, disability, loss of breadwinner
and other legal grounds. Older people are the property of our society. In our country, the legal norms that
perpetuate the rights of all citizens, regardless of age, as well as norms specifically relating to the elderly,
is one of the foundations for building a rule-of-law state. In the spheres of pensions and partially social
services, there is a sufficiently detailed regulation of the rights of elderly citizens. At the same time, it
should be noted that at present neither the employer nor the state as a whole are very much interested
in employment and employment of older people after their retirement. Thus, the reality of the facts calls
for special consideration of elderly citizens as a vulnerable group that is the object of many punishable
acts, but with fewer means to provide adequate protection.
Analysis of the current situation shows the need to strengthen the regulatory framework that takes
into account all the characteristics of a person’s state of old age and identifies a number of problematic
issues on the effective protection of older people.
