Statute of limitations for criminal offenses under the new Penal Code of the Republic of Kazakhstan

Abstract

In the present paper we consider the form of exemption from criminal liability in connection with the expiration of statute of limitations on the new Criminal Code of the Republic of Kazakhstan in 2014. A comparative analysis of the rules of exemption from criminal liability in connection with the expiration of the limitation period under the Criminal Code of the Kazakh SSR, the Criminal Code of 1997 and the new Criminal Code of 2014. Disclosed base and the conditions under which a person who has committed a criminal offense and a crime can be exempted from criminal liability in connection with the lapse of time. Conducted a comprehensive analysis of controversial issues has allowed the author to conclude that the rules governing the statute of limitations for serious crimes, contrary to the provisions of the conceptual categories of offenses under the criminal law of Kazakhstan.
