Abstract

The authors considers the example of the conventional organs of the United nations, such as the General Assembly of the UN, the Commission on Human Rights, the Sub-Commission on Promotion and Protection of Human Rights, ECOSOC, the UN High Commissioner for Human Rights and other bodies for the protection of fundamental rights and freedoms of man and citizen. During consideration of question the authors identified some shortcomings in the current modern system protecting the rights and fundamental freedoms within the United Nations , such as cumbersome nature of their work , failure, as well as duplication and overlap in the exercise of its powers , the lack of clear and coherent coordination among the different conventions and non-conventional bodies; pronounced general human rights norms contained in certain international treaties and acts of “soft law” ; optional legal nature of decisions , untimely and sometimes unfair representation of member States or States Parties of their national reports; small , limited size of the budget of the United Nations to promote and protect human rights, inability to respond promptly to emergencies related to massive human rights violations.
