Actual problems of liability for violation of the legislation on mineral resources.

Abstract

This article seeks to address the conditions and basis of liability for violations in the field of mineral resources with a view to their effective use. Analyzed the existing normative legal acts in this field. A comparative analysis of the practice of criminal liability of corporate persons with other countries. Considered a basic condition to prosecute the person harm the environment. Proves that a claim for compensation of damages in full is not always economically feasible. Based on research by the author is that the role of the criminal responsibility in providing rational and complex use of the subsoil is somewhat limited, however, in addressing a number of specific tasks, it may not be effective enough.
