Normative resolutions of the Constitutional Council of Republic of Kazakhstan and its specific us a part of law.

Abstract

The purpose of work is definition, whether the decision of body of the constitutional control of sources of the right are among, whether carry resolutions of the Constitutional Council and the constitutional courts of other states standard character. The methodology of work was made by a dialectic method, concrete historical, comparative, sociological methods of research and a method of modeling and forecasting. Results of work was the conclusion that standard resolutions of the Constitutional Council of RK are the law in force, possess all lines of a normativnost. The author proves that standard resolutions of the Constitutional Council are a component of branch of a constitutional law, entering as a component into constitutional and legal institute «Right of Quasijudicial Constitutional Control», and also a subject of studying of science of a constitutional law within one of the scientific directions.Scope, the results received by the author of article improvement of the constitutional legislation fixing legal status of the Constitutional Council of RK is. Conclusions of the author can be used in the course of teaching at law departments of disciplines of a constitutional and legal cycle.
