Abstract

In this article the objective party a crime connected with monopolistic activity is considered. The objective party of a crime consists in its external manifestation in the surrounding reality, infliction of harm causing or creating threat to object of a crime. In a generalized view the objective party is characterized by socially dangerous act (action or inaction), its consequences, a causal relationship between act and consequences, and also way, time and a situation of commission of crime. From the objective party the considered crime contains two independent types of violation of the antitrust law: the monopolistic actions directed on establishment of exclusively high or exclusively low prices, and competition restrictions.
