The article examines current trends in digitalization and the implementation of artificial intelligence technologies in the field of labor relations in the Republic of Kazakhstan. The authors analyze the impact of digital platforms, automated personnel management systems, and algorithmic solutions on the legal status of employees and employers. Particular attention is paid to the need to adapt labor legislation to new digital realities, including in the context of the 2025 Address of the President of the Republic of Kazakhstan, K.-J. Tokayev, which emphasizes the strategic importance of human capital development and the protection of labor rights in the context of technological transformation. The paper compares Kazakhstani and international experience in the legal regulation of artificial intelligence in the labor sphere, identifies the risks of algorithmic discrimination and violations of the principle of equality, and proposes directions for the modernization of national legislation. It concludes that there is a need to integrate ethical and legal standards of the digital era into the labor law system of Kazakhstan.
In addition, the necessity of developing unified standards for digital employment is emphasized, particularly for regulating activities in platform-based labor markets, where traditional approaches to defining labor relations are often insufficient. The importance of protecting employees’ personal data, preventing algorithmic discrimination, and ensuring a balance of interests between the parties to labor relations in the context of economic digitalization is also highlighted.
